Earth Angels English Shepherds Contract This Agreement is made and Hereby entered into on this _____ day of _________ in the year of _________ between Ruth Hippler (hereafter referred to as “seller”) and ________________________________ (hereafter referred to as “buyer”) for the purpose of setting up terms and conditions of the purchase by the buyer of a pure breed English Shepherd from the litter whelped on ____, ____, ______ out of sire ________________________ Registered with ___________________________ registration #__________________________ and Dam _______________________________________ Registered with _________________________________________________ registration#_________________________ 1) The seller agrees to sell and the buyer agrees to buy one puppy ( hereafter referred to as “puppy”) from the above described litter. 2) The deposit of at least $200 is due at the time of signing. 3) The seller and the buyer will work together to determine which puppy is the best one for the buyers home but the buyer agrees that the seller has the final say in this determination. If the buyer is not satisfied with the sellers decision buyer must say so, in writing, before taking ownership of the puppy. 4) The seller warrants that the puppy will be in good health at the time the buyer assumes ownership. Buyer agrees to have puppy examined by a licenced Veterinarian within 72 hours, (not including week-ends or holidays) of receipt of puppy. If, as a result of the examination, the veterinarian determines that the puppy is not in good health, then the buyer shall elect to either keep the puppy or return the puppy to the seller for a full refund of the purchase price of $300. If the buyer elects to return the puppy, buyer will provide the seller with a written veterinarian’s certificate stating that the puppy was in poor health when examined and all paperwork buyer received on the puppy at the time of purchase. Upon receipt of puppy, Veterinarians certificate and all paperwork, the seller shall be obligated to refund all monies received from the buyer towards the purchase of the puppy, and further performance under this contract shall be null and void. All action taken to return the puppy shall be with the puppy’s best interest in mind, including temperature a the time of shipping, non-stop flights, etc 5) The buyer agrees that any and all transportation cost to and/or from the sellers premises, will be at the expense and sole responsibility of the buyer. 6) The buyer agrees to maintain preventative care for the puppy in regards to Hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (ie. not allowing puppy to jump from heights taller than itsself at the shoulder, no forced exercise such as running, until at least 18 mths of age.) Buyer must keep puppy in fit weight and condition. 7) The buyer agrees that the puppy will NOT be chained or tied out and will not be subjected to excessive confinement without adequate exercise. The buyer agrees that the puppy will reside at the buyers home. Puppy is sold with the understanding that he/she is to go to a select home, be socialized properly, and become a valued member of the family. 8) If the buyer has the puppys hips x-rayed after the age of two years and before the age of 30 mths, and examined by either Orthopedic Foundation for Animals (OFA), and the puppy is diagnosed with Severe Dysplasia, the buyer agrees to spay/neuter puppy immediately. Seller will refund $200.00 to the buyer upon receipt of written Veterinarians statement that puppy was spayed or neutered, and upon receipt of a copy of the OFA results showing the puppy’s dysplasitc condition. The buyer releases the seller of responsibility for results of x-rays done after 30 mths. 9) The buyer agrees that the puppy will not be used for breeding purposes until he or she is at least 18 mths of age and then only be bred to another English Shepherd ( registered to IESR, UKC, ARF of ESCR) If the puppy is a bitch, buyer agrees that the breeding shall be no more often than every other heat cycle, or no more than one back to back cycle with a one year rest before breeding again. Should the buyer breed puppy without meeting ALL the requirements listed in this section, the buyer acknowledges the sellers right to repossess the puppy and all offspring derived from the breeding in question. There will be NO REFUND of any monies paid and it will be left to the sellers discretion as to the placement of the puppy and offspring. 10) The buyer agrees that he/she is not acting as or in part of, an agent in the purchase of puppy and that the buyer will not sell the puppy or any of her progeny to any agent, broker or pet shop. 11) Should the puppy exhibit agressive behavior which buyer deems intolerable and irreversible within the puppys first year of life, the buyer will provide seller with proof that the puppy has been sufficiently socialized and that obedience classes and other structured training methods have been attempted with no results. Buyer will then return puppy to seller at buyers expense. Upon receipt of such proof and return of puppy, the seller will refund $200 to buyer. 12) The buyer agrees that should it become necessary to rehome puppy for any reason, the buyer will notify the seller before taking such action. The seller has the right to take the puppy back at this time with no refund of purchase price. The seller will always take the puppy back if that is the buyers wish but if the buyer has other preferences the seller will consider them in making a decision. If the buyer rehomes or sells puppy without first contacting seller, the buyer hereby acknowledges that the seller has the right to repossess puppy from the new home and buyer will be responsible for any legal fees that such proceedings incur. 13) The buyer agrees that the seller may repossess puppy upon evidence of neglect or abuse at no expense to seller, and no refund of monies to the buyer. 14)The buyer releases the seller from all responsibility for health issues once the puppy is 30 mths of age and the buyer releases the seller from all temperament issues once the puppy reaches the age of 12 mths. All other portions of this contract will remain in effect for the puppy’s entire life. 15) The buyer agrees to notify the seller of the time and circumstances of the puppy’s death. This agreement is made and signed by both parties to insure the well being and protection of the puppy. If any part of the agreement is breached by the buyer, the seller is released from all further obligations hereunder.
